These Terms of Service ("Terms") are a legal agreement between you and Red Panda Fencing Inc. ("Red Panda," "we," "us," or "our") governing your access to and use of the Touch By Touch High Schoolwebsite, mobile application, and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service supports fencing organizations, rosters, schedules, attendance, scoring, rankings, and historical results. Some information, including school and team information, athlete names and graduation years, meet and bout results, and fencer records, may be published for public viewing and search-engine indexing.
Touch By Touch is a recordkeeping and event-management tool. It is not the official governing body for a competition and does not replace official rules, rulings, eligibility decisions, medical advice, or emergency services. When the Service conflicts with an official event record or governing-body determination, the appropriate official controls.
"Your Content" means information or materials you submit, upload, enter, or publish through the Service, including rosters, athlete information, scores, signatures, scoresheet images, logos, and corrections.
You may not use the Service to:
Except with our prior written permission, you may not use bots, crawlers, scrapers, scripts, browser automation, data-mining tools, or other automated means to access or interact with the Service.
In particular, you may not:
These restrictions do not prohibit general-purpose public search engines from crawling public pages solely to create ordinary search indexes when they honor our robots instructions, or access through a tool, export, or interface that we expressly authorize. Public visibility of a page does not authorize bulk collection or reuse. Nothing in these Terms restricts rights that applicable law does not allow us to restrict.
The Service, including its software, design, text, graphics, branding, and original selection and arrangement of content, is owned by Red Panda or its licensors and is protected by applicable intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purposes. No other rights are granted.
School names, team names, logos, and other third-party materials remain the property of their respective owners. Factual competition data may have different legal protection from original Service content; the contractual access and use restrictions in these Terms apply regardless.
We may add, change, suspend, or discontinue features, and we may correct or remove content. We do not promise uninterrupted availability or permanent retention of every item. You are responsible for keeping any copies of information you are required to retain independently.
We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated, access creates risk for users or the Service, or action is necessary to comply with law. Where appropriate, we may investigate suspected automated extraction, preserve relevant records, revoke credentials, and block associated accounts or systems.
You may stop using the Service at any time and may delete your sign-in account through the mobile application. Account deletion does not automatically erase public historical competition records; correction and deletion requests are handled as described in the Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RECORDS OR CALCULATIONS WILL ALWAYS BE COMPLETE OR ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED PANDA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service must be brought in the state or federal courts located in New Jersey, and each party consents to those courts' jurisdiction and venue, except where applicable consumer law requires otherwise.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganization, merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us concerning the Service.
We may update these Terms from time to time. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when reasonably practicable. Your continued use of the Service after revised Terms take effect means you accept the revised Terms.
